Why Some UFO Files Were Not Released Immediately

Introduction
When the final Ministry of Defence (MoD) UFO files were released, including material connected to the Rendlesham Forest incident, one of the most significant disputes was not over what the files contained but over why some records were withheld, delayed or redirected elsewhere. By the late stages of the UFO file disclosure programme, Freedom of Information Act 2000 (FOIA) exemptions under Sections 21 and 22 played a central role in shaping what requesters received and when they received it. Why Sections 21 and 22 Mattered
The final release programme for MoD UFO records coincided with growing public interest in Rendlesham and other well-known cases. These exemptions were procedurally different from secrecy-based exemptions. They did not necessarily claim the information was sensitive. Instead, they focused on how and when the information would become available.
Already Public Material Under Section 21
Section 21 allows a public authority to refuse a request when the requested information is already reasonably accessible through another route. The Information Commissioner’s Office describes it as an exemption designed to prevent FOIA from duplicating existing access arrangements. In the Rendlesham context, this became relevant because some of the most sought-after documents had already entered the public domain. As more UFO material was digitised and catalogued by The National Archives, requesters could increasingly be directed to records that were already available through archive holdings rather than receiving fresh disclosure packages from the MoD itself. For campaigners, however, this sometimes felt unsatisfactory. A document could technically be available, yet still require archive searches, catalogue knowledge or paid reproduction services. Critics argued that directing requesters elsewhere occasionally created the impression of openness while still making access less straightforward than a direct release.
Future Publication Under Section 22
Section 22 was even more significant during the final UFO-file release programme. This exemption applies when an authority intends to publish information in the future and it is reasonable to withhold it until that planned publication occurs. The MoD’s UFO archive project created exactly the circumstances for which Section 22 was designed. Throughout the late 2000s and early 2010s, the department and The National Archives were carrying out staged transfers of UFO files. Files were reviewed, redacted where necessary and then released in organised batches. Why These Exemptions Became Controversial
The controversy was not primarily legal. It was political and cultural.
Rendlesham had developed a reputation as Britain’s most famous UFO case, and many requesters believed undisclosed records might contain decisive evidence. As a result, arguments about disclosure procedures became intertwined with arguments about the incident itself. Delays that archivists considered routine were sometimes interpreted by enthusiasts as evidence of institutional reluctance to release information.

The exemptions helped determine whether information arrived immediately through FOIA or later through a planned archival release. In the Rendlesham case, this distinction mattered because public interest was exceptionally high and every delay was scrutinised.
The lasting lesson is that later public understanding of Rendlesham was shaped not only by events in Suffolk in December 1980 but also by twenty-first-century information law.
